Terms of Service

These terms govern your use of Estately, an online marketplace for booking experiences on private estates across the UK and Europe. By creating an account, making a booking or listing an experience, you agree to these terms. Please also read our Privacy Policy, which explains how we handle your personal data.

1. Who we are

Estately is operated by Join Estately Ltd (Company No. 17327738), registered at Flat 5, 74 Gloucester Street, London SW1V 4EF, United Kingdom ("Estately", "we", "us"). You can contact us at hello@joinestately.com.

2. Definitions

  • "Guest" — a person who books, or seeks to book, an Experience through the platform.
  • "Host" — a person or business that lists Experiences on their estate through the platform.
  • "Listing" — a page describing an Experience a Host offers, including its price, availability, minimum age and cancellation policy.
  • "Experience" — the activity a Host provides, such as a driven shoot, fly fishing, falconry, riding, a vineyard tour or a farm day.
  • "Booking" — a confirmed reservation of an Experience by a Guest, formed as described in section 5.

3. Accounts

You must be at least 18 years old to create an account or make a Booking. You agree to provide accurate information, keep it up to date, and keep your login credentials secure. You are responsible for activity that happens under your account. We may suspend or close accounts that breach these terms (see section 14).

4. Our role — a marketplace, not the provider

Estately is an intermediary. We provide the platform on which Hosts advertise Experiences and Guests book them. When a Guest books an Experience, the contract for the Experience itself is between the Guest and the Host, not with Estately. Hosts are solely responsible for their Experiences, including their description, safety, legality, insurance and delivery. We do not own, operate, inspect or supervise Experiences, and while we may carry out checks on Hosts and Listings, we do not guarantee any Listing's accuracy or any Host's performance.

5. Bookings and payment

  • All prices are shown in pounds sterling (GBP). Each Listing states whether its price includes or excludes VAT; the total payable is shown before you confirm.
  • Payment is taken at the time of booking through our payment processor, Stripe. Your card details are provided directly to Stripe and never touch Estately's servers.
  • Depending on the Listing, a Booking is confirmed either immediately on payment or once the Host accepts your request. If a Host declines a request, you will be refunded in full.
  • You agree to pay for Bookings only through the platform. Arranging or paying for a platform-introduced booking off-platform to avoid fees is a breach of these terms.

6. Cancellations and refunds

Each Listing has a cancellation policy set by the Host, shown on the Listing and at the point of booking. That policy determines what refund (if any) you receive when you cancel, based on how far in advance you cancel. Refunds are returned via Stripe to your original payment method.

If a Host cancels a Booking, you will receive a full refund. Where an Experience cannot safely go ahead (for example, dangerous weather for a shoot or river conditions for fishing), the Host may offer an alternative date or a refund in line with their policy. Nothing in this section affects your statutory rights as a consumer.

7. Host obligations

As a Host, you warrant and agree that:

  • your Listings are accurate, complete and not misleading, including prices, what is and is not included, minimum ages and physical requirements;
  • you hold, and will maintain, every licence, permission, certificate and insurance policy required to provide your Experiences lawfully — including, for regulated activities such as shooting and stalking, all applicable firearms and shotgun certificates, game licences and land permissions, and appropriate public liability insurance;
  • you comply with all applicable law, including health and safety legislation, and provide competent supervision, safety briefings and appropriate safety equipment for every Experience;
  • you enforce the minimum ages stated on your Listings and refuse participation where it would be unsafe or unlawful;
  • you honour confirmed Bookings except where cancellation is genuinely necessary;
  • you have the right to use all photos and content you upload (see section 10).

8. Guest obligations

As a Guest, you agree that you and everyone in your party will:

  • follow the Host's safety instructions and briefings at all times, and use any safety equipment provided;
  • meet the minimum age and any physical or licensing requirements stated on the Listing (some activities, such as shooting, have legal age and certification requirements);
  • disclose anything reasonably relevant to safe participation, such as medical conditions or lack of experience, when asked;
  • respect the Host's property, livestock and land, and behave lawfully and considerately;
  • not attend an Experience under the influence of alcohol or drugs.

Hosts may refuse or stop participation, without refund, where a Guest's conduct puts safety at risk.

9. Assumption of risk

Many Experiences on Estately are outdoor countryside activities that carry inherent risks — including shooting, deer stalking, horse riding, fishing and working with animals. Terrain, weather, animals and firearms are unpredictable, and injury is possible even when an Experience is run properly. By booking, you confirm that you understand and voluntarily accept the inherent risks of the activity for yourself and your party, and that you are responsible for judging whether an Experience is suitable for you.

This section does not exclude or limit anyone's liability for death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Content and intellectual property

Hosts retain ownership of the photos and text they upload, and grant Estately a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and promote that content on and off the platform for the purpose of operating and marketing the service. You must only upload content you have the right to use, and it must not be unlawful, misleading or offensive. We may remove content that breaches these terms.

The Estately name, site design and software are our intellectual property (or that of our licensors). You may not copy, scrape or reuse them except as needed to use the platform normally.

11. Platform fees

Guests pay the price shown on the Listing. Hosts pay Estately a commission on each Booking — currently 20% of the booking total — which is deducted before the Host is paid out. The applicable rate is shown in the host dashboard and may change on reasonable notice; changes apply only to Bookings made after the change takes effect.

12. Prohibited conduct

You must not:

  • use the platform for anything unlawful, or list an Experience you cannot lawfully provide;
  • circumvent the platform to avoid fees (see section 5);
  • harass, threaten or discriminate against other users;
  • post false reviews, misleading Listings or content you have no right to post;
  • scrape, copy or index the platform, or interfere with its operation or security;
  • impersonate any person, or create accounts by automated means.

13. Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded — and nothing in them affects your statutory rights as a consumer.

Subject to that: Estately provides the platform "as is" and is not liable for the acts or omissions of Hosts or Guests, for the quality, safety or legality of Experiences, or for losses that were not foreseeable when you accepted these terms. Our total liability to you arising out of the platform in any 12-month period is limited to the greater of the fees we earned from your Bookings in that period and £100. We are not liable for business losses where you use the platform as a consumer.

14. Suspension and termination

You may close your account at any time. We may suspend or terminate your account, remove Listings, or cancel Bookings if you materially breach these terms, if we reasonably suspect fraud or a safety risk, or if the law requires it. Where reasonable, we will give you notice and a chance to respond. Sections that by their nature should survive (including 9, 10, 13 and 15) survive termination.

15. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over disputes arising from them — except that if you are a consumer living elsewhere in the UK or in the EU, you keep the benefit of any mandatory protections of, and may bring proceedings under, the law of the country where you live.

16. Changes to these terms

We may update these terms from time to time, for example to reflect changes in the law or the service. The "Last updated" date above shows the current version. For material changes we will give reasonable advance notice (for example by email or a notice on the site); changes do not affect Bookings already made. If you continue using the platform after a change takes effect, the updated terms apply to you.
